Medical liability and personal injury law

The contract between a doctor and the patient includes the obligation for the doctor to give to the patient conscientious, attentive care in accordance with the information and data acquired from science. The physician is under an obligation of means towards the patient. If the doctor fails to fulfill this obligation, they shall be liable in accordance with the conditions of contractual liability.

Accompaniment of patients who are victims of medical error before the Conciliation and Compensation Commissions, administrative or judicial judges according to the scope of practice of the doctor whose liability is in question.

Honoraires

Conformément au principe de liberté, les honoraires du Cabinet sont fixés d’un commun accord avec le client.

Les modilités d’intervention et de facturation sont prévues par une convention d’honoraires entre le client et le Cabinet.

La détermination du montant des honoraires dépend de plusieurs facteurs, comme le temps passé ou la complexité du dossier.

La facturation au temps passé s’effectue sur la base d’un taux horaire proposé par le Cabinet et accepté par le client. Ce taux horaire est communiqué lors du premier rendez-vous. Différents taux peuvent être appliqués en fonction du statut de la personne intervenant sur le dossier.

Pour certaines affaires, les honoraires du Cabinet peuvent reposer partiellement sur un honoraire de résultat. Cet honoraire de résultat est prévu par la convention d’honoraires.

Les honoraires sont déterminés indépendamment des frais annexes, comme les frais de dossier, les droits à acquitter, les frais d’intervenants extérieurs, les frais de correspondance, ou les frais de déplacement.

Les honoraires sont soumis à la TVA à hauteur de 20%.
